The unraveling of the relationship between Sean “Diddy” Combs and Diageo marks the end of a lucrative but at times tumultuous partnership between the hip-hop mogul and the spirits giant. Going forward, Diageo intends to market the affected brands, Ciroc vodka and DeLeon tequila, without its high-profile partner.

The dispute arose earlier this month, when Combs sued Diageo, alleging the company long underinvested in DeLeon tequila while devoting more attention to other brands it owned, such as Casamigos, the George Clooney-backed tequila Diageo acquired in 2017 for $1 billion. Combs also alleged the company pigeonholed DeLeon as a Black brand, which allegedly limited its distribution compared to other Diageo brands.

In a motion to dismiss the case Tuesday, Diageo argued that Combs failed to live up to his obligations in the partnership and that his complaints should be directed to arbitration, pursuant to an earlier agreement. Diageo separately said it was ending its relationship with Combs, saying he “repeatedly undermined our partnerships.” Combs’ attorney John C.

Hueston stated that Diageo’s move amounts to “a cynical and transparent attempt to distract from multiple allegations of discrimination,” while alleging that Combs “has repeatedly raised concerns as senior executives uttered racially insensitive comments and made biased decisions based on that point of view.

He added that Combs “brought the lawsuit to force them to live up to that contract, and instead they respond by trying to get rid of him. This lawsuit and Mr. Combs are not going away.” Diageo owns the Ciroc brand but turned over its marketing and promotion to Combs in 2007.

“But Diageo certainly has the resources to try to retain and continue growing them if it wishes. The question is how much upside Diageo sees in them.” Diageo’s response to the lawsuit alleged Combs had invested $1,000 into the DeLeon joint venture whereas Diageo devoted more than $100 million. “If Diageo wanted to keep the brand, I wonder if they would use that argument,” said Sarah Barrett, executive editor of Wine & Spirits Daily.

Hueston stated that Diageo’s “new, apparent focus on monetary funding belies the immense value Mr. Combs brought to establishing and growing the DeLeon brand.” Ciroc remains the second-largest above-$25 vodka brand in the U.S. after Grey Goose, Marstellar said, citing Impact Databank figures.

But the brand was down 4.5% last year and has averaged an annual 2.5% decline over the past five years. DeLeon posted 72% growth to 120,000 cases in the U.S. last year but grew slower than other Diageo-owned tequila brands, Casamigos and Don Julio, which each sold more than 2 million cases.
